The Sovereign advantage

If you work in professional services, you’re subject to a higher duty of care and responsibility because of your unique qualifications and expertise. And with these higher standards comes greater risks, like the possibility that a client could take legal action against you if they believe you’ve made a mistake, been negligent or provided poor advice. Whether you’re at fault or not, Professional Liability coverage helps protect your business, your professional integrity and your reputation from potentially costly lawsuits. No matter what industry you’re in, our experienced team works closely with your broker to provide complete solutions to reduce or eliminate potential gaps in coverage – providing easy solutions for potentially complicated risks.

Claims-made coverage

We’re renown for our claims service. Our experienced claims team handle your claim efficiently and keep you informed throughout the process. What’s more, our Professional Liability contracts are "claims made" (which means that you're covered for claims that occur during your policy term, as long as they are reported as soon as practicable), not "claims made and reported" (which would only cover you for claims that occur and are reported to your insurer during your policy term).

No gaps in protection

Liability claims aren’t always covered under the protection that is mandated for your profession. We work with you and your broker to fill challenging coverage gaps for niche industries by offering standalone coverage (like Trustee’s Errors and Omissions) or combined coverages (such as a General Liability office package with our Errors and Omissions or Cyber coverage). We’re truly a one stop shop.

A better experience

We don’t believe in hoops and hierarchy when it comes to supporting our brokers and clients. Our experienced underwriters are trusted with local decision-making authority, which means faster and more agile service. With experts in six offices across Canada, Sovereign has a local presence, and brings in-depth knowledge of provincial laws and regulations.

Coverages designed to protect your business

We offer a broad range of insurance coverages to reflect the specific risks faced by your profession and your business. And for associations or groups with multiple insureds, we can develop an insurance program at a standardized form and rate. Some of our key coverages include:

Miscellaneous Professional Liability

Miscellaneous Professional Liability

Coverage snapshot

Everyone makes mistakes sometimes, but for some professional positions the stakes are higher. Miscellaneous Professional Liability provides coverage when a mistake causes monetary loss due to error, omission or misrepresentation in providing professional services. However, bodily injury and property damage are excluded from this coverage.

Imagine a scenario where...

An employment recruiter for a corporate client finds a candidate with a management background to fill a senior officer role in a prominent company. The company subsequently discovers that the recruiter had neglected to check the candidate's credentials and hired someone who didn’t have the prerequisite university degree to hold the position. The company demands significant damages from the recruiter. Miscellaneous Professional Liability can help cover the defense costs and settlement fees incurred by the recruiter.

As a health practitioner, you always work with your patient’s best interest in mind. You take every precaution, but there’s always the chance that you could be held liable for bodily injury (including emotional / mental anguish) arising out of something that was not properly administered or neglected while providing medical or therapeutic services. Miscellaneous Malpractice Liability provides coverage to allied health practitioners and clinics to cover damages and legal expenses should a claim be brought against you.

Imagine a scenario where...

A patient goes to a homeopath with sinus problems and is prescribed low doses of arsenic as a remedy. But shortly after taking the arsenic, the patient suffers a violent asthma attack. It turns out the patient’s pre-existing medical condition (allergy) was improperly assessed by the homeopath and the patient decides to sue for damages. Miscellaneous Malpractice Liability can help cover the practitioner’s costs for damages and legal representation.

Architects and Engineers

Architects and Engineers

Coverage snapshot

As an architect or engineer, you design and build the spaces where families and communities gather and where we live our daily lives. As a result of this important work, your responsibility to public safety is great. But no one’s work is immune from mistakes; if a design flaw emerges, causing damage to property or injury to people, it’s important that you’re protected. Architects and Engineers is a practice policy that covers the design and consulting provided by an architect, engineer or technologist. It provides coverage for damages and expenses during disciplinary, tribunal and occupational health and safety hearings. It can also provide coverage for Bodily Injury and Property Damage arising from design related wrongful acts.

Imagine a scenario where...

Your engineering firm is hired to design and manage the installation of a large, decorative glass wall located in an office tower. Three months after the installation, the glass wall suspension system begins to fail and tear away from the building’s ceiling. The building owner files a lawsuit for faulty design and site supervision. Architects and Engineers can help cover your costs for damages and legal representation.

Media Liability

Media Liability

Coverage snapshot

In today’s digital age, the pace at which information is released to the public is faster than ever before. It can be difficult for publishers, broadcasters and media firms to keep pace, while upholding the integrity of their content. Mistakes and errors in judgement can happen. Media Liability provides coverage for copyright infringement, libel and slander, IP infringement, trademark infringement and patent infringement claims. This includes bodily injury coverage for emotional distress or mental anguish and a $100K limit with respect to the cost of recall, reproduction, reprinting or correction of material.

Imagine a scenario where...

A model and actor discovers his picture on some food packaging while grocery shopping. The manufacturer grabbed his photo from his online portfolio and used it under the mistaken belief that it was royalty-free stock photography. They didn’t receive sign-off from the model nor did they obtain permission to use the image. In this situation, Media Liability can help cover any damages incurred by the manufacturer and the costs to pay for the use of the image.

Manufacturers Errors and & Omissions (E&O)

Manufacturers Errors and & Omissions (E&O)

Coverage snapshot

Mistakes happen. It’s how you recover from them that matters. Our Manufacturers Errors and Omissions Liability coverage can help protect your business from financial loss and legal costs for errors like:

  • Design errors
  • Faulty installations
  • Improper use of raw materials
  • Subcontractor errors
  • Product failures

And with our Specifications coverage, we can help cover you for expenses you incur to repair or replace your product.

Imagine a scenario where…

You manufacture a custom-made motor that is designed to generate a specific amount of power. Weeks after the motor is installed at your customer’s production facility, they report that the motor is generating less power than it was designed for and their production capacity has been impacted. Cue the domino effect: your customer incurs extra expenses to shut down the production line, replace the motor with a more expensive alternative and to top it all off, they lose one of their contracts because of the production delay. Not surprisingly, your customer sues you for the lost revenue and extra expenses. The motor still works, and there is no bodily injury or physical property damage so the Commercial General Liability doesn’t provide coverage. But Manufacturers Errors and Omissions Liability does!

Trustee Errors and Omissions

Trustee Errors and Omissions

Coverage snapshot

You abide by your duty to protect and serve the interests of your clients, still, trustees can be heavily scrutinized by beneficiaries, other family members, and even third parties. It’s important to ensure you’re protected in case you’re sued as a result of your actions as a trustee. Whether you’re entrusted with a small family trust or a multi-million-dollar estate, a lawsuit can be brought against you for a variety of reasons, including:

  • Improper accounting (e.g. failure to adhere to generally accepted accounting principles)
  • Mishandling of assets or investment decisions (e.g. selecting unprofitable or unproductive investments)
  • Self-dealing (e.g. the trustee benefits personally from the sale or purchase of trust assets)
  • Conflict of interest (e.g. a lawyer who is acting as a trustee sells trust property to one of his clients)
  • Failure to gain the most favorable tax treatment

Even basic disputes can be extremely costly. In cases of family trusts, lawsuits can carry on for years as family tensions contribute to, and are often the cause of, disputes.

Imagine a scenario where…

A lawyer is appointed the trustee executor of an estate, which includes a house. As the deceased had lived in the home for 50 years, the trustee holds a garage sale to sell all the ‘junk’, including an oil painting, which sells for $10. A beneficiary later comes forward and indicates that the deceased had some valuable art pieces, including the painting the trustee had sold for $10. Cost to the estate was $65,000 (the value of the painting at auction). Trustee Errors and Omissions can help cover the trustee's costs for damages and legal representation.

Excess coverage – across all industries

Excess coverage – across all industries

Coverage snapshot

Every business is required to obtain a certain amount of insurance coverage – either by an industry regulator, or a partner like a contractor or casualty insurer. But what is required isn’t always enough. We can help you get what you actually need based on the risks to your unique operations. Excess Coverage provides additional coverage limits for Errors and Omissions insurance, across any of our approved industry classes.

Imagine a scenario where...

Your organization is growing fast. You’ve doubled the number of professionals working in your firm in the last year and are taking on much larger clients, with greater monetary risk. Excess coverage with increased limits can help ensure your business’s risk exposures are protected.
